Season Contract Terms
Parties
This agreement is between Eagle Point Outdoor Services ("we," "us") and the Season Contract holder ("you").
Services
- Up to 10 snow removal visits during the season.
- Each visit clears the driveway, walkway and sidewalk at the service address, with salt applied at every visit (as indicated during our on site visit and/or in your notes).
- Automatic dispatch when snow accumulation reaches at least 3 inches at the service address, when it is safe and weather permits. Snow that has not yet been cleared keeps counting toward the 3 inches, so back to back snowfalls are combined into one visit. You do not need to book each visit.
- Maximum one visit per 24 hours, even if snow continues to fall or falls again.
- Priority response. Contract holders are cleared before one time customers, once conditions are safe.
- Special requests. Season Contract holders may put special requests or directions in their notes, such as early mornings, where vehicles are usually parked, or needing to be out of the house by a certain time. If you request a specific schedule, we will schedule your visits around it when it is safe and weather permits.
Visits
- How visits are counted. Each 24 hour period counts as one visit. If snow falls again within that period, we will return after 24 hours, and that counts as your next visit. A storm lasting several days is counted by 24 hour period.
- Heavier service counts as 2 visits. A 24 hour period counts as 2 visits if accumulation reaches 18 inches or more, because the snow takes two passes to clear, or if you ask for clearing before snowfall has ended (for example, you need to leave the property) and we clear during the storm and return afterward. A 24 hour period never counts as more than 2 visits.
- Drifting and return visits. If you ask us to return within 24 hours for drifting snow, or because a vehicle was in the way, it is billed at 50% of our on demand rate for your size.
- End of the driveway and curb ramps. If the city plow leaves a ridge at the end of the driveway or on the curb ramps after service, we will return to clear it as part of your special request. It is not charged and does not count as a visit.
- Extra service. Additional visits for any other reason are available to order at our on demand rate.
Your responsibilities
- Keep the service area reasonably accessible. Move vehicles, trash cans, toys and other items before a storm when you can. We cannot clear under or around vehicles that block the work area.
- Please indicate any hidden hazards so we can work around them, such as sprinkler heads, landscaping, pet fences, uneven pavers, loose or damaged concrete, or siding.
- Keep pets inside during service.
- Make sure we have access to the property, including gates.
- Tell us the areas you want included or left out. Only the driveway, walkway and sidewalk are included unless we agree otherwise in writing.
Season, carryover and unused visits
- The season runs from November 1 to March 31.
- Unused visits expire at the end of the season. There is no refund, and no carryover except as described below.
- If snow falls shortly after March 31 and you still have visits left, we will honor them.
- Carryover. If you renew within one month after the season ends, up to 2 unused visits are added to your new contract, for a maximum of 12 visits. Any other unused visits expire.
- If winter brings fewer qualifying snowfalls than 10, the contract is still valid and no refund is owed.
- Your visit balance. We will notify you on your 8th visit that you have 2 visits remaining. You may add 5 more visits at a discounted rate, with salt included. The price is based on your contract size and is provided on request. Adding visits is not required.
- If you use all your visits and want more without buying a pack, you keep your Season Contract priority and may buy individual visits at our on demand rate.
Referrals
If you refer a neighbor who purchases a Season Contract, one free additional visit is added to your contract. The neighbor should mention your name in their notes or in their reply before paying.
Contract size
Your contract size is determined by the estimated square footage of your property. Square footage is also what sets how long a visit takes, which is how we base the pricing:
- Small (up to about 650 sq ft, about 30 minutes)
- Medium (about 650 to 1,000 sq ft, about 45 minutes)
- Large (about 1,000 sq ft and up, about 60 minutes)
These are estimates, not limits. If we find at the first visit that your property is a different size than chosen, we will tell you and adjust the contract to the correct size and price before the next visit. Properties that take longer than 60 minutes are quoted separately.
Payment
- The full contract price is due before your first visit. Your contract is active once we receive payment.
- Multiple payment methods are available. We send a secure payment link for electronic payment.
- If electronic payment is not available, we can arrange another method, including picking up payment at your property.
Your route and refunds
- You do not need to schedule anything. Season Contract visits are automatic. When you are set up, we place you on our route and let you know your usual service window, based on your notes. Windows are approximate and depend on snowfall and conditions.
- Before the first visit: you may cancel the contract for a full refund.
- After the first visit: the contract is not refundable, in whole or in part.
- If we are unable to serve your property due to repeated blocked access, we may end your contract and refund your unused visits.
Weather and safety
- The safety of our crew is our number one priority. If conditions are unsafe, or the weather does not permit, we may delay the visit. A delayed visit counts as one visit once completed, and we will not charge for a visit we did not complete.
- Extreme storms, equipment failure or illness may cause delays. We will communicate by text or call.
Salt and surface notes
Salt melts snow and ice but can affect some surfaces, plants and pets, and cannot make a surface fully ice free. Salt is included on every visit unless you tell us otherwise in your notes or by reply to your welcome message. If you say no, we skip salt and the contract price stays the same. Salt does not guarantee a surface will be safe from slipping.
Damage and liability
- We take care with your property. Snow clearing can cause minor wear to edges, pavers, gravel and surfaces that were already cracked, loose or damaged.
- We are not responsible for damage to items hidden under snow or not made known to us, to pre existing damage, or to gravel and unpaved surfaces.
- If you believe we caused damage, please report it within 48 hours with a photo so we can look at it. We will repair or compensate for damage caused through our negligence.
- We are not responsible for injury from slipping on a surface after service, since snow and ice can reform. You remain responsible for keeping your property safe for visitors.
Crew
We may use employees or subcontractors to perform visits. We remain responsible for the service under this agreement.
Changes and ending the agreement
- Either side may end this agreement by written notice, subject to the refund rules above.
- We may update these terms between seasons. Changes during an active season apply only if you agree in writing.
- If you sell or move, please let us know. The contract does not transfer to a new owner unless we agree in writing.
Privacy and communications
We value your privacy and the security of your personal information. We use your contact information only to provide your service, send visit updates and handle payment. We do not sell it or share it with anyone else. You agree we may call or text you about visits. Your card information is handled by our payment processor, and we do not store full card numbers.
General
- This agreement is governed by the laws of the State of Wisconsin. Any dispute will be handled in La Crosse County.
- This is the entire agreement between us for the Season Contract. Changes must be in writing and confirmed by text or email by both sides.
- If any part of this agreement cannot be enforced, the rest stays in force.
Acceptance
By sending payment and replying to your welcome message, you accept these terms and the service. No signature is needed.
